DECLARATION
OF COVENANTS, CONDITIONS AND RESTRICTIONS CALICO MEADOWS STATE OF
KNOW ALL MEN BY THESE PRESENTS
This Declaration made on the date hereinafter
set forth by CALICO MEADOWS, hereinafter referred to as “Developer”. W I T N E S S E T H: WHEREAS, Developer is the owner of
that certain tract of land known as Calico Meadows, being a subdivision
containing 7.042 acres of land situated in Blanco County, Texas (hereinafter
referred to as the “Property” or the “Subdivision”) with the plat
of Calico Meadows being recorded in the office of the County Clerk
of Blanco County, Texas on the 24th day of June, 2005 after
having been approved as provided by law, and being recorded in Book
1, Page 355 in the Records of the Maps and Plats of Blanco County,
Texas; and, WHEREAS, the Declarant desires to hold
and from time to time convey the Property, or any portion thereof,
subject to certain protective covenants, conditions, restrictions,
liens and charges hereinafter set forth; and, WHEREAS, Declarant wants to identify
and describe the additional property which may be incorporated within
the scheme of this Declaration; and, WHEREAS, Declarant desires to create
and carry out a uniform plan for the improvements, development and
sale of the Property for the benefit of the present and future owners
of the Property. NOW, THEREFORE, KNOW ALL MEN BY THESE
PRESENTS, that it is hereby declared (I) that all of the Property
shall be held, sold, conveyed and occupied subject to the following
easements, restrictions, covenants and conditions, which are for the
purpose of protecting the value and desirability of, and which shall
run with the Property and shall be binding on all parties having any
right, title or interest in or to the Property or any part thereof,
their heirs, successors, and assigns, and shall inure to the benefit
of each Owner thereof, and (ii) that each contract or deed which may
hereafter be executed with regard to the Property or any portion thereof
shall conclusively be held to have been executed, delivered, and accepted
subject to the following covenants, conditions and restrictions regardless
of whether or not the same are set out or referred to in said contract
for deed. ARTICLE 1 DEFINITIONS
Unless the context otherwise specifies
or requires, the following words and phrases when used in this Declaration
shall have the meanings hereinafter specified: 1.1 Architectural Control Committee. “Architectural Control Committee” shall mean
the committee created pursuant to this Declaration to review and approve
plans for the construction of Improvements upon the Property.
1.2
Articles. “Articles” shall mean
the Articles of Incorporation of Calico Meadows Property Owners
Association, which shall be filed in the office of the Secretary of
State of Texas, and as from time to time amended.
1.3
Assessment. “Assessment” or “Assessments”
shall mean such assessments as may be
levied by the Association under the terms and provisions of this Declaration. |
